The use of CCTV by a school/ETB without an individual’s knowledge is generally unlawful. There should be no covert surveillance using CCTV on school property. Where CCTV cameras are erected, there should be clear, legible signs informing people of their presence and in operation. Where An Garda Siochana requests to carry out covert surveillance on school/ETB premises, such surveillance may require the consent of a judge. Accordingly, any such request made by An Garda Siochana should be made in writing and the school/ETB should seek legal advice.
