Images taken by pupils on personal devices which are not owned by the School

It should be noted that the school's data protection policy does not apply to personal data kept on personal devices which are not owned by the school and which are used by an individual for purely personal, family or household affairs, or for recreational purposes. Accordingly, in general photos and video clips taken by students on personal devices which are not owned by the school and which are taken for purely personal, family, household affairs or for recreational purposes will not come within the school's data protection policy. However, schools/ETBs understand that as part maintaining a nurturing school environment which is respectful and safe, they have a role to play in ensuring that students develop a respectful and appropriate attitude to the internet, social media, and their mobile devices. In circumstances where children or young people take photographs or video clips of other pupils, and other individuals, on their own personal devices which are not owned by the school, for their own use, similar ground rules should be agreed in partnership with parents/guardians.

  • Images should only be taken with the knowledge and consent of participants.
  • No images should be taken which could give rise to embarrassment or distress.

To this end it is advisable to set a clear policy for the use of mobile phones in school. Schools are advised to put in place a Acceptable Usage Policy re Digital Personal Devices/Phones etc.  and ensure that this dovetails with the school’s Code of Behaviour.
