Taking or Using Images and Photos

Photographs or recorded images may come within the scope of the Data Protection Acts 1988-2003. Accordingly, the Data Protection Policy of the school/ETB will need to clearly explain to parents/guardians what images of their children will be collected and processed by the school/ETB, and the uses to which those images will be put by the school/ETB.

Parents/guardians should be furnished with a copy of the policy relating to taking and using photos at enrolment stage and must give their written consent to their child’s images being taken and used.

For students already enrolled in the school/ETB, a copy of the school's data protection policy and any other policy relating to taking and using photos should be sent to their parents together with a form requesting the parent/guardian’s written consent to their child’s images being used for as long as the student is enrolled in the school (ie, to cover all photos which may be taken by the school during the student's time in the school). the student’s time in the School). This sample language needs to be appropriately tailored. So for example, where images may be used for a variety of purposes (e.g., documenting, promoting or celebrating through press overage, websites, prospectuses etc.), consent for each purpose and/or in a variety of settings (e.g., reports, public media, or websites) should be obtained on an “opt-in” basis. The language used should be simple and clear. These written forms of consent signed by the student’s parent(s)/guardian(s) should be carefully stored on each student’s file. Parents/guardians should be advised to inform the school if circumstances change and they no longer wish their child’s image to be taken, used or retained.
